Terms of Use

1. Who we are and what this covers

app.modelpie.ca (the "Portal") is a private property-management web application operated by Brighton Shores Summer Estates Ltd., an Ontario corporation operating as Timber House Resort ("we", "us", "our"). The Portal runs on the ModelPie software platform, which is owned separately from Brighton Shores Summer Estates Ltd. and made available to us under licence. ModelPie's public information site is modelpie.ca; it has its own terms and privacy notice.

These Terms of Use ("Terms") govern your use of the Portal. They are separate from the Terms of Service for timberhouse.net, which govern our public website and online store, and separate from any Seasonal Licence of Occupation, tenancy agreement, event agreement, non-disclosure agreement or the Property Rules that you have signed or agreed to. If these Terms conflict with a signed agreement, the signed agreement governs the matter it covers.

By logging in to or using the Portal you agree to these Terms and to our Privacy Policy at app.modelpie.ca/privacy. If you do not agree, do not use the Portal.

Properties on the Portal. The Portal is built to serve more than one property, with each property's data kept separate. At present the only property publicly served through the Portal is Timber House Resort. If additional properties or operating entities are added, this section will be updated to identify them and the entity responsible for each.

2. Access and accounts

The Portal is private. There is no public sign-up. Accounts are created by us as part of an onboarding process for seasonal licensees, residential occupants, event partners, data-room partners, staff and interns. We may decline to create an account, or may suspend or close one, at our discretion.

Your account has a role (for example Customer, Property Manager, Administrator or Intern) that determines what you can see and do. You may only use the Portal for the purposes your role is intended for.

You are responsible for:

  • keeping your password and any sign-in method (including Google sign-in) secure and not sharing your account;

  • all activity that occurs under your account;

  • telling us promptly at jjohnston@timberhouse.net if you believe your account has been compromised.

3. Your information

You agree that the information you enter in the Portal — your contact details, secondary contact, emergency contact, insurance details, vehicle information and consents — is accurate and that you will keep it up to date. Some of this information is used for safety and emergency purposes, so accuracy matters. Where you provide information about another person (a spouse, secondary occupant or emergency contact), you confirm that you have their permission to do so.

4. Acceptable use

You may not:

  • access or attempt to access data belonging to another property, another user, or a role you have not been given;

  • share your login, or let anyone else use your account;

  • copy, scrape, download in bulk, or redistribute Portal data other than your own records;

  • probe, scan, or test the security of the Portal, or try to bypass access controls, row-level security, or authentication;

  • upload malicious code, or interfere with the Portal's operation or the services it depends on;

  • use the Portal for any unlawful purpose or in breach of any agreement you have with us;

  • misrepresent who you are or your relationship to a property.

Interns and observers have read-only access and may not disclose Portal data outside the program they are part of.

5. Contracts, notices and acknowledgments

The Portal displays contracts (for example a Seasonal Licence of Occupation or storage contract), notices, and explanatory documents such as the hydro, water-testing and property-tax explainers. It also records acknowledgments you give — for example that you have read the Property Rules.

  • Documents generated by the Portal are copies for convenience. The signed agreement (paper or electronically signed) is the binding version.

  • Acknowledging an explainer means you confirm you have read it. It does not change the terms of your agreement.

  • Notices posted in the Portal supplement, and do not replace, any method of notice required by your agreement or by law.

6. Fractional sharing

If your agreement permits it, the Portal lets you share your trailer or site with other people during the season by creating a sharing group. You choose who is in the group and when each member uses the site; the Portal calculates the resulting allocation of charges. You remain the licensee and are responsible for your group members' compliance with your agreement and the Property Rules. Group members are guests of yours, not licensees, and must be registered in the Portal before they occupy the site. Fractional sharing is not a short-term rental service and may not be used to offer the site to the public.

7. Utility billing and financial information

The Portal calculates how shared costs — flat-rate electricity (hydro), water testing and similar charges — are allocated among sites, and shows you a "billing explainer" for your site. These calculations are management tools. They:

  • are provided to help you understand how charges are allocated;

  • may contain errors, and may be corrected;

  • are not an invoice, receipt, tax document or financial statement. Invoicing and payment collection happen outside the Portal under your agreement with us.

If you believe a calculation is wrong, tell us and we will review it.

8. Events and ticket payments

The Portal issues tickets for resort events. Tickets may be purchased on timberhouse.net (processed by Shopify) or directly through the Portal (processed by Square).

  • Square payments. When you buy a ticket through the Portal, Square processes your payment. Your card details are entered on and handled by Square; we never receive or store your card number, expiry or security code. Square's own terms and privacy policy apply to the payment.

  • Sandbox notice. Square payment processing in the Portal is currently in test mode. No real payment is taken through the Portal. Live ticket sales are currently made through timberhouse.net. [Remove this paragraph when Square goes live.]

  • Each ticket has a unique code and QR code and admits one person to the named event. Tickets are non-transferable unless we say otherwise for a particular event.

  • Refunds and cancellations for tickets follow the Refund Policy published on timberhouse.net, regardless of which channel you bought from.

9. Data room (partners)

Access to the partner data room is available only to people who have accepted the non-disclosure agreement presented in the Portal. Everything in the data room, including saved scenario calculations, is confidential information under that agreement. We log data-room visits. Financial showcases and scenario models are illustrative and are not an offer, forecast, or investment advice.

10. Intellectual property and open source

The ModelPie software is open-source software licensed under the GNU Affero General Public License v3.0 with additional terms set out in its LICENSE file. Source code is available under that licence; commercial licensing and brand questions can be sent to licensing@modelpie.io. Nothing in these Terms grants you any right in the ModelPie name or branding.

The content and data within the Portal — contracts, billing records, maps, documents, and records about the property — belong to Brighton Shores Summer Estates Ltd. or to the person the data is about, and are not covered by the open-source licence. You may use your own records for your own purposes.

11. Third-party services

The Portal is built on and connects to third-party services, including Supabase (database and authentication), Vercel (hosting), Make.com (document generation and automation), Google Workspace (email sent from our Gmail account), Square and Shopify (ticketing and payments), Google (sign-in) and map-tile providers. These are described in the Privacy Policy. Those services have their own terms, which apply to your interaction with them (for example when you pay through Square). We are not responsible for their availability or conduct.

12. Availability and changes

The Portal is provided "as is" and "as available". We are a small operator and do not promise uninterrupted or error-free service. We may change, suspend or discontinue any feature, or the Portal itself, at any time. Where we discontinue the Portal, we will give reasonable notice and make your own records available to you.

13. Suspension and termination

We may suspend or close your account if you breach these Terms, if your relationship with the property ends, or if we discontinue the Portal. Ending your Portal access does not end your rights and obligations under any signed agreement with us. We keep records after your account closes as described in the Privacy Policy.

14. Disclaimer and limitation of liability

To the maximum extent permitted by Ontario law, we and our directors, officers, employees, contractors, interns and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or revenue, arising from your use of or inability to use the Portal, or from errors in calculations, readings or documents displayed in it. Our total liability to you for claims arising from the Portal is limited to $100 CAD. Nothing in this section limits liability that cannot be limited by law, or liability under a signed agreement, which is governed by that agreement.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree to the non-exclusive jurisdiction of the courts of Ontario.

16. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest revision. For material changes we will notify you by email or in the Portal. Continued use after the effective date of a change means you accept it.
